These Terms of Service ("Terms") govern your use of the hosting services provided by Canada's Hosting Company ("Company", "we", "us"). By purchasing or using our services, you agree to be bound by these Terms.
1. Services
We provide web hosting, VPS, dedicated server, and game server hosting services as described on our website. Service availability and features are as detailed on the applicable product pages at the time of purchase.
2. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must be at least 18 years of age to create an account.
3. Acceptable Use
You may not use our services to:
- Host or distribute illegal content under Canadian or international law
- Send unsolicited commercial email (spam)
- Conduct DDoS attacks or other malicious network activity
- Mine cryptocurrency without prior written approval
- Host phishing pages, malware, or other harmful software
- Violate any third-party intellectual property rights
Violation of this policy may result in immediate service suspension without refund.
4. Billing & Payment
All prices are in Canadian dollars (CAD) unless stated otherwise. Services are billed in advance on a monthly or annual basis. Failure to pay within 7 days of the invoice due date may result in service suspension.
5. Refund Policy
We offer a 7-day money-back guarantee on web hosting plans (first-time purchases only). VPS, dedicated server, and game server services are not eligible for refunds after the server has been provisioned.
6. Uptime Guarantee
We guarantee 99.9% network uptime per calendar month, excluding scheduled maintenance. If uptime falls below this threshold, we will issue service credits as follows:
- 99.0%–99.9%: 10% credit of monthly fee
- 95.0%–99.0%: 25% credit of monthly fee
- Below 95.0%: 50% credit of monthly fee
Credits must be requested within 30 days of the qualifying downtime.
7. Data & Backups
While we provide backup services, you are ultimately responsible for maintaining your own backups of critical data. We are not liable for data loss.
8. Limitation of Liability
Our total liability for any claim arising from these Terms shall not exceed the amount paid by you for the affected service in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Termination
Either party may terminate services at any time. We may terminate without notice for violation of the Acceptable Use Policy. Upon termination, your data will be retained for 30 days before permanent deletion.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify active customers of material changes at least 30 days in advance via email.
